By using EmployNext, you agree to these Terms and our Privacy Policy. These Terms explain how EmployNext works, how your information is used, and your responsibilities as a participant.

1. Introduction

These Terms of Service (the “Terms”) govern your access to and use of EmployNext, an online employment‑readiness and job‑search support platform operated by EmployNext powered by Serco Canada Inc. (“EmployNext,” “we,” “our,” or “us”). These Terms apply to the EmployNext website, associated portals, and any browser‑based or mobile software (collectively, the “Services”).

By using the Services, you represent that you are at least 18 years old, legally able to enter a binding agreement under the laws of Ontario, Canada, and you agree to be bound by these Terms and our Privacy Policy and or you have consent from your guardian to participate in these services. We may modify or discontinue features at any time. Where feasible, we will provide reasonable notice of material changes; however, we may implement changes immediately for security, legal, or performance reasons. Continued use after changes take effect constitutes acceptance.

2. EmployNext

EmployNext is an Employment Ontario service. By registering, you agree to how we collect and use your information, what your responsibilities are as a participant, and how we work with the Ministry of Labour, Immigration, Training and Skills Development (MLITSD). These Terms explain how we support your job search, what information we share to deliver the program, and what you can expect from us.

3. Explicit Consent to Data Collection

By registering for EmployNext, you provide explicit consent for the collection, use, and disclosure of your personal information as described in the EmployNext Privacy Policy. This includes your acknowledgement and acceptance that your information may be shared with the Ministry of Labour, Immigration, Training and Skills Development (MLITSD) systems for the purposes of program delivery, reporting, monitoring, and compliance. You understand that this consent is required in order for EmployNext to deliver Employment Ontario services in accordance with provincial requirements.

4. Client Responsibilities

As a registered client, you agree to provide accurate, complete, and truthful information throughout your participation in EmployNext services. You understand that your successful engagement may require attending scheduled appointments, participating in assessments, responding to communications, and providing required documents in a timely manner. You also agree not to misuse staff time, system resources, or represent yourself in a way that misstates eligibility or service needs.

5. What You Can Expect from Us

EmployNext is committed to providing high quality, inclusive, and accessible Employment Ontario services. You can expect professional support from trained staff, clear communication about your appointments and service options, and a respectful environment free from discrimination or harassment. You can also expect that we will safeguard your personal information, provide reasonable accommodations when requested, and work collaboratively with you to develop an effective employment plan, connect you with opportunities, and support your progress toward employment.

6. Client Rights

As a participant in Employment Ontario services through EmployNext, you have the right to be treated with dignity, respect, and fairness. You have the right to accessible services and to request accommodations at any time under the Accessibility for Ontarians with Disabilities Act (AODA). You have the right to ask questions about your file, request corrections to inaccurate information, and access your personal information as permitted by law. You may withdraw consent for optional service components at any time; however, mandatory reporting requirements to MLITSD will continue as part of Employment Ontario program participation. 7. Consent for Program Evaluation & Quality Assurance

By participating in EmployNext services, you consent to the use of data derived from your records for the purposes of program evaluation, service planning, reporting, quality assurance, audit activities, or research conducted by EmployNext, Serco, or MLITSD. Add a line about Ministry approved 3rd party vendors.

8. Interactions in the Employment Ontario Ecosystem

To deliver Employment Ontario services and coordinate supports, EmployNext interacts with the following, as applicable to your case:

  • Employment counsellors/coaches and program staff who provide assessment, case management, workshops, and job‑search supports.
  • Employers (and their authorized representatives) to understand hiring needs, facilitate matches, confirm placements, or support retention.
  • Provincial program systems/authorities (e.g., MLITSD program systems) were required to deliver Employment Ontario services and meet funding or reporting requirements.
  • Vendors under contract that provide secure hosting, case management, analytics, customer support, or communications services, acting on our instructions under confidentiality and security obligations.
  • Community partners/service providers you work with or authorize (e.g., settlement, health, accessibility, or training providers) to coordinate wrap around supports and referrals; if a referral involves material or sensitive information, EmployNext may require your written consent before proceeding.

How personal information is collected, used, disclosed, safeguarded, and retained, including any de‑identified or aggregated program reporting, is governed by the EmployNext Privacy Policy, which forms part of these Terms by reference. 9. Accounts & Eligibility

The Services are intended for individuals aged 18+ located in Ontario. If you access the Services for someone else (e.g., assisting a client), you represent that you are authorized to bind that person to these Terms. We may require identity or eligibility verification and may refuse, suspend, or revoke accounts where warranted.

10. User Content, Case Notes, and Records

You may provide information such as your name, contact details, résumé, education, job preferences, job‑search activity, uploaded documents, and similar materials (“User Content”). Counsellors and staff may add case notes, tasks, workshop attendance, and outcome checkpoints (“Program Records”). Collectively, we call these “Records.”

License to operate and improve -You grant EmployNext to create and use aggregated and/or data derived from Records for benchmarking, insights, reporting, research, product improvement, and service planning.
Third Party Access by Approved Ministry Vendors – If your access is arranged by a third party (e.g., an employment service provider), you consent to our sharing limited usage information with that organization as described in our Privacy Policy.
Legal requests -We may disclose Records if required by law, court order, or lawful request, to the extent required.
By registering, you understand that counsellors will create case notes, record interactions, and document progress to support your employment plan and meet program requirements.

11. Third Party Integrations

EmployNext may allow clients to connect with third party tools or services, such as calendar integrations, SMS messaging platforms, email services, or job board APIs (e.g., ESCases, Xeekers, Service Provider Specific software’s). By choosing to use these integrations, you acknowledge that third party providers have their own terms of use and privacy practices, which are separate from EmployNext. EmployNext does not guarantee the availability, accuracy, security, or performance of external systems, and clients are responsible for reviewing permissions and settings before connecting any third party accounts.

12. Sharing Collected Data

The Services may allow you to share Records with counsellors, employers, or other parties. Sharing outside the Employment Ontario network is at your discretion and risk; we cannot control recipients’ use. Role‑based access is managed by program administrators; supervisors may review counsellor activity for quality and compliance. The Ministries may receive reports and, where permitted, limited usage data. See the Privacy Policy for data‑handling details.
To deliver Employment Ontario services, EmployNext will securely share your information with MLITSD for program administration, oversight, and reporting. Information may also be shared with employers, community partners, or other third party services when needed to support your employment action plan or coordinate services. We take the protection of your personal information very seriously, and will only share what is necessary to provide you with quality support. All third party providers supporting EmployNext operations are bound by strict confidentiality and security obligations to safeguard your information. We apply rigorous security practices, limit access to authorized personnel only, and continually work to protect your privacy. We do not sell your information or use it for non program purposes, and all handling of your information follows the EmployNext Privacy Policy.

13. Communications & Notifications

The engagement with EmployNext may support secure messaging, task reminders, event/workshop invites, and email notifications. You consent to receive service‑related communications electronically. We promise not to use messaging for spam, harassment, or unlawful content. If you connect external tools (e.g., calendar/email integrations), you authorize the necessary data flows; third‑party providers’ terms apply.

14. Job Postings & Labour‑Market Information

Job postings and labour‑market information may come from third parties and can change without notice. EmployNext does not endorse or warrant their accuracy or availability and is not responsible for outcomes related to such information. Use your judgment and verify details with the source.

15. Acceptable Use

You agree not to engage in any conduct that violates applicable laws, regulations, or third party rights. This includes, but is not limited to, the following prohibited actions: You may not upload malware or attempt to disrupt, interfere with, or place undue burden on the Services; probe, scan, or attempt to access non public areas or systems; scrape, crawl, or harvest data except through the publicly supported interfaces provided to you upon acceptance into the Integrated Employment Services program; publish benchmarks or performance tests without our prior written consent; use the Services to train or improve competing products; send spam or any deceptive, fraudulent, or unlawful communications; or engage in any activities that infringe privacy, intellectual property, or other protected rights. We may monitor usage for security, quality, and service improvement purposes, and we may throttle, suspend, or terminate access for any conduct that violates these Terms.

16. Software License

We grant you a limited, revocable, non‑exclusive, non‑transferable license to use our software and third-party Ministry approved vendors software’s to access the Services. You may not reverse engineer, decompile, circumvent security, or create derivative works. Software may update automatically; updates are covered by these Terms.

17. Intellectual Property

All platform materials are owned by EmployNext powered by Serco Canada Inc. or its licensors and protected by Canadian law. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works. This includes the use of our logo (EmployNext & Serco), marketing material, and training/ information material.

18. Informed Consent for AI Assisted Features

EmployNext may provide AI assisted features, including résumé suggestions, job matching insights, skills recommendations, referral recommendations, plan item recommendations, and labour market prompts. These AI generated outputs are for informational purposes only and do not constitute legal, financial, immigration, or other professional advice. You are responsible for ensuring that any information you enter into the system and any AI generated output complies with applicable terms and does not include confidential or sensitive data. You acknowledge that you must independently verify all AI generated recommendations before acting on them, and that EmployNext cannot guarantee the accuracy, completeness, or suitability of any AI generated content, nor accept liability for its use.
You are responsible for any text, images, or other content you enter or upload to EmployNext / ESCases AI system(s) (“Input”), as well as any material generated by the system based on that Input (“Output”). You must ensure that both your Input and Output comply with these terms before using or sharing them, and you agree not to include any confidential or proprietary information.

19. Reliable Service

We aim for reliable service but do not guarantee uninterrupted availability. Maintenance (planned or emergency) may occur without notice. From time to time, we may offer beta or trial features; these are provided as‑is, may be changed or withdrawn at any time, and may be subject to additional terms.

20. Term; Suspension; Termination

These Terms start when you first use the Services and continue for as long as your information is stored in: EmployNext, ESCases, and MLITSD databases.
We may suspend or terminate access immediately if you breach these Terms, pose risk to the platform or others, or where required for legal, security, or operational reasons. On termination, you must stop using the Services.

21. Professional & Outcome Disclaimers

The Services, including all guidance, AI assisted suggestions, and any content created in whole or in part using generative AI, are provided for informational purposes only. We make no warranty or guarantee regarding the accuracy, completeness, or reliability of any AI generated output, and we do not accept any liability arising from your use of such content or from any errors or omissions it may contain. The Services do not constitute legal, immigration, financial, or other professional advice, and we recommend that you obtain independent professional guidance before acting on any information produced by the system. You acknowledge that any reliance on AI generated content is entirely at your own risk, and we do not guarantee interviews, job offers, or any employment outcomes.

22. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless EmployNext powered Serco Canada Inc., its affiliates, and their directors, officers, employees, and agents from and against all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Services; (b) your User Content; (c) your breach of these Terms; or (d) your violation of law or third‑party rights. We may assume control of the defense; you agree not to settle any matter involving us without our written consent.

23. Limitation of Liability

To the maximum extent permitted by Ontario law, EmployNext and Serco are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, business, goodwill, or profits, even if advised of the possibility. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

24. Updates to These Terms

We may update these Terms periodically by posting a new version with an updated Effective Date. Changes take effect on the stated effective date. Your continued use after changes take effect constitutes acceptance.

25. Governing Law; Venue; Jury Waiver

These Terms are governed by the laws of the Province of Ontario and applicable Canadian federal law. All disputes will be resolved exclusively in the courts located in Ontario. Both parties waive any right to a jury trial to the fullest extent permitted by law.

26. Notices & Electronic Communications

You consent to receive electronic communications. We may provide notices via email to your account email and by posting within the Services. Notices are deemed received 24 hours after sending/posting. You are responsible for keeping your contact details current. Legal notices to EmployNext:[email protected].

27. Accessibility (AODA)

We strive to provide accessible services in alignment with the Accessibility for Ontarians with Disabilities Act (AODA). For accommodations or an accessible version of these Terms, contact [email protected].
Clients may request accessibility-related accommodations at any time to support participation in EmployNext services. EmployNext will make reasonable efforts to work with clients and relevant community partners to coordinate or facilitate appropriate supports in alignment with the Accessibility for Ontarians with Disabilities Act (AODA). If you require an alternative format, communication support, or service adjustment, you may contact us at any time to initiate the accommodation process.

28. Consent Confirmation

By proceeding with registration, you confirm that you have read, understand, and agree to these Terms of Service and the EmployNext Privacy Policy. You acknowledge that participation in Employment Ontario services requires the collection and sharing of certain personal information with the Ministry of Labour, Immigration, Training and Skills Development (MLITSD) for program delivery, reporting, and accountability.
